Discontinuous permanent workers represent a particular employment model in Spain: a permanent but intermittent relationship, linked to cyclical or seasonal activities. This type of employment has expanded significantly in recent years and now accounts for more than 6% of indefinite contracts in Spain.

This raises a key question: how does access to unemployment benefits work for discontinuous permanent workers?

Right to unemployment benefits

During periods of inactivity, discontinuous permanent workers maintain their contractual link with the company but do not receive a salary. In these periods, they can register with the Spanish Public Employment Service (SEPE) as job seekers “with an employment relationship.” This registration allows them to access unemployment benefits, provided they meet the same requirements as any other employee: a minimum of 360 days of contributions in the last six years.

Requirements to apply for unemployment benefits

The discontinuous permanent worker must meet the following basic conditions:

  • Be in a legal situation of unemployment.

  • Register as a job seeker.

  • Accredit at least 360 days of contributions.

  • Not have reached the legal retirement age.

  • Not carry out another full-time activity.

  • Not receive a pension incompatible with employment.

Steps to apply

  1. Register as a job seeker once the campaign or period of activity ends.

  2. Gather the required documentation, such as DNI or NIE, Social Security card, family book, bank document, and company certificate.

  3. Submit the application either online via SEPE’s electronic headquarters or in person at the benefits office (with an appointment).

The deadline to submit the application is 15 business days from the start of the legal unemployment situation.

Resume or request a new benefit

In this type of contract, workers may:

  • Resume a suspended benefit, maintaining the same regulatory base and pending duration.

  • Request a new benefit, provided they have accumulated at least 360 additional contribution days.

SEPE informs the worker of both options so they can choose the most advantageous one.

Calculation and duration of the benefit

  • Duration: depends on the days contributed in the last six years. From 360 days, the worker is entitled to 120 days of benefits, progressively increasing.

  • Amount: calculated based on the regulatory base (average contribution bases for the last 180 days worked).

    • 70% of the base for the first 180 days.

    • 60% from day 181 onwards.

There are maximum and minimum thresholds updated annually, depending on whether the worker has dependents.
